Online sales: Changes to the rules governing the right of withdrawal

As of June 19, 2026, e-commerce businesses must have a new feature that allows consumers to exercise their right of withdrawal directly through their online interface.

This requirement arises from Article 3 of Ordinance No. 2026-2 of January 5, 2026, regarding the distance marketing of financial services to consumers, which amends Article L.221-21 of the French Consumer Code. Under the amended provision, traders to provide consumers with a “feature enabling them to exercise their right of withdrawal free of charge” before expiry of the 14-day withdrawal period.

This feature allows the consumer to submit an online withdrawal request, informing the business of their decision to withdraw from the contract.

Article 2 of Decree No. 2026-3 of January 5, 2026, specifies the requirements applicable to this new withdrawal feature, which must be (i) clearly displayed, (ii) directly and easily accessible to the consumer, and (iii) remain available throughout the withdrawal period:

  • The withdrawal feature must be labelled “Withdraw from the contract here,” or with similarly, clear and unambiguous wording, displayed in legible text;
  • By clicking on this feature, the consumer must be able to easily complete or confirm the following information: their full name, sufficient details to identify the contract from which they wish to withdraw, and the electronic means by which they wish to receive confirmation of receipt of their withdrawal request;
  • After completing or confirming this information, the consumer must be able to submit their request through a confirmation button labelled: “Confirm Withdrawal,” or with similarly, clear and unambiguous wording, displayed in legible characters;
  • Once the consumer has submitted his withdrawal request, the seller must provide the consumer, within a reasonable timeframe, with an acknowledgment of receipt on paper or any other durable medium. This acknowledgment of receipt must include, in particular, the content of the withdrawal request together with the date and time it was submitted.
